NOTICE TO PUBLIC OF FINDING OF NO SIGNIFICANT IMPACT

AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

On or about August 12, 2020, or 15 days from the publication of this Notice, whichever is later, the City of Fort Wayne will authorize The Housing Authority of the City of Fort Wayne to submit a request to the Department of Housing and Urban Development for the release of Energy Performance Contract funds under the United States Housing Act of 1937, as amended, to undertake a project known as the Fort Wayne Housing EPC Contract. This project consists of:

 

All projects consist of efforts to reduce energy consumption, including the replacement of existing lighting with the installation of new LED lighting and lighting fixtures and technology throughout each apartment community and other activities as listed below.

 

Beacon Heights Apartments – Project includes the installation of MAU and exhaust system, energy Star-rated washers, and occupancy/setback T-stats in common areas as needed.

Estimated Funding: $662,409.00

Project Location: 2210 Beacon Street, Fort Wayne Indiana, 46805

 

Village of Brooklyn Pointe – Project includes the installation of new hard water aerators.

Estimated Funding: $7,650.00

Project Location: 2003, 2007, and 2011 Nuttman Avenue, Fort Wayne, IN 46809

 

Miami Homes Apartments – Project includes the installation of a new DHW tankless heater in community/laundry building along with the install of new Energy Star-rated washers.

Estimated Funding: $40,826.00

Project Location: 2111 Cheyenne Drive, Fort Wayne, Indiana 46809

 

North Highland Apartments – Project includes the installation of new exterior photocells, and elevator cab lighting throughout the apartment community, and replacement of new MAU and exhaust system, Energy Star-rated washers, heat pump units, and occupancy/setback T-stats in common areas as needed.

Estimated Funding: $900,330.00

Project Location: 2100 St. Mary’s Avenue, Fort Wayne IN 46808

 

Tall Oaks Apartments – Project includes the installation of exterior photocells and elevator cab lighting throughout the apartment community, and replacement of existing washers with Energy Star-rated washers, heat pump units, and occupancy/setback T-stats in common areas as needed.

Estimated Funding: $171,396.00

Project Location: 7300 Decatur Road, Fort Wayne IN 46816

 

Whispering Oaks Apartments – Project includes the installation of new hard water aerators.

Estimated Funding: $8,512.00

Project Location: 7284-7288 Decatur Road, Fort Wayne IN 46816

 

Project may include interior and exterior construction/rehabilitation, as well as all activities generally associated with such a project.

 

 

FINDING OF NO SIGNIFICANT IMPACT

The City of Fort Wayne has determined that the project will have no significant environmental impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Fort Wayne, Citizens Square, 200 East Berry, Suite 320 and may be reviewed Monday through Friday from 8:00am to 5:00pm.

 

ENVIRONMENTAL CERTIFICATION

The City of Fort Wayne certifies to HUD that Thomas Henry in his capacity as Mayor of the City of Fort Wayne consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Fort Wayne Housing Authority to use Program funds.

 

PUBLIC COMMENTS

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the City of Fort Wayne and should be addressed to: OHNS Environmental Review, 200 East Berry Street, Suite 320, Fort Wayne, IN 46802.  Comments may also be emailed to [email protected]. All written and/or emailed comments received by 5 p.m. on August 12, 2020, or 15 days from the publication of this Notice, whichever is later, will be considered by the City of Fort Wayne prior to submission of a Request for Release of Funds. Comments should specify which Notice they are addressing.

 

RELEASE OF FUNDS

The City of Fort Wayne certifies to the Department of Housing and Urban Development that Thomas C. Henry in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and allows the City of Fort Wayne to use HOME funds.

 

OBJECTIONS TO RELEASE of FUNDS

HUD will accept objections to its release of funds and the City of Fort Wayne’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Fort Wayne; (b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Section 58.76) and shall be addressed to the Indianapolis Office of Public Housing Director at:
